1. Acceptance of terms

Welcome to FindingList. By accessing or using our website at findinglist.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including homeowners seeking contractors, contractors listing their businesses, and visitors who simply browse the directory.

2. Description of service

FindingList is an online directory and lead-routing platform that connects homeowners with local home improvement contractors. Our Service includes:

• A searchable directory of contractor listings, organized by service category and location.
• A quote request system that allows homeowners to submit project details and have them routed to up to three qualified contractors.
• An owner portal where contractors can manage their listings, upload logos, edit business details, and view leads.
• Paid features including lead credits, Verified badges, and Featured placement.
• Email-based authentication and OTP verification for secure account access.

We do not perform home improvement work, employ contractors, or guarantee the quality of services provided by listed contractors. We are a marketplace — not a party to any contract between homeowners and contractors.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are not prohibited from using the Service under applicable law.

4. For homeowners

4.1 Quote requests

When you submit a quote request through our Service, your contact information (name, email, phone) and project details will be shared with up to three contractors who serve your area. This is the core function of our Service, and by submitting a request, you consent to this sharing.

You agree to provide accurate, complete information when submitting quote requests. You agree not to submit fraudulent, abusive, or spam requests. We may limit the number of quote requests you can submit if we detect abuse.

4.2 Hiring contractors

FindingList is a directory — we do not employ, endorse, or guarantee the work of any contractor listed on our Service. Our "Verified" badge indicates that we have confirmed the business is legitimate and operating — it is not a warranty of work quality. Our "Featured" badge indicates a contractor has paid for premium placement — it is not an endorsement of their work.

Before hiring any contractor, you should independently verify their license, insurance, references, and qualifications. Any contract for services is strictly between you and the contractor. We are not a party to that contract and have no liability for the contractor's performance.

4.3 Reviews

We display Google reviews for listed businesses. These reviews are the property of Google and its users. We do not moderate, edit, or remove Google reviews — that is solely Google's responsibility. If you believe a Google review is fraudulent or violates Google's policies, please report it directly to Google.

5. For contractors

5.1 Listing your business

You may list your business on FindingList for free. You agree to provide accurate information about your business, including your name, address, phone, email, services, license number, and insurance info. You must have the authority to list the business and bind it to these Terms.

If your business is already listed (we pre-populate some listings from public records), you may claim it by verifying ownership via our OTP-based email verification process. By claiming a listing, you take responsibility for the accuracy of its contents.

5.2 Lead credits and payments

When a homeowner submits a quote request that is routed to you, you may need lead credits to view their contact information. Lead credits can be purchased in packages via PayPal. The pricing is publicly displayed on our Service and varies by service category (roofing, HVAC, plumbing, etc.).

• Credits do not expire. Once purchased, your credits remain available until used.
• Credits are non-transferable. They are tied to your business and cannot be moved to another business or account.
• Credits are consumed when a lead is auto-accepted (you have credits) or when you manually accept a pending lead.

5.3 Verified and Featured badges

Our "Verified" badge is a paid feature ($99/year) that signals to homeowners that we have confirmed your business is legitimate. It also unlocks all 10 social media profile slots on your listing. Verification does not guarantee leads, ranking, or any specific business outcome.

Our "Featured" badge ($29/month or $290/year) gives your business premium placement in search results within your service area. Featured placement is subject to availability and may be shared with other Featured contractors in the same area.

Both badges can be revoked at any time if your business is found to have provided false information, violated these Terms, or engaged in fraudulent activity. Refunds for revoked badges are at our sole discretion.

5.4 Conduct

You agree not to:

• Submit false or misleading information about your business.
• Use the Service to harass, spam, or solicit homeowners for unrelated services.
• Misuse lead information — including adding homeowners to marketing lists without consent, sharing their information with third parties, or contacting them after they've explicitly opted out.
• Attempt to circumvent the lead credit system (e.g. asking homeowners to contact you directly to avoid paying credits).
• Create fake reviews, either for your own business or against competitors.
• Impersonate another business or individual.
• Use automated systems (bots, scrapers) to access the Service without our prior written consent.

Violations may result in immediate suspension or removal of your listing, forfeiture of unused credits, and permanent ban from the Service.

6. Intellectual property

The Service, including its design, text, graphics, logos, and software, is the property of FindingList and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our prior written consent.

Business listings and their contents (logos, descriptions, photos) are the property of the respective businesses. By listing your business, you grant us a non-exclusive, royalty-free license to display your business information on our Service for the duration of your listing.

7. User content

You are solely responsible for any content you submit to the Service (e.g. business information, logos, project photos). You represent and warrant that you have all necessary rights to submit the content and that it does not violate any third-party rights.

We reserve the right to remove any content that we believe violates these Terms, applicable law, or is otherwise objectionable. We have no obligation to monitor user content but will investigate and act on reported violations.

8. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for suspension may include:

• Violation of these Terms or our Privacy Policy.
• Fraudulent activity, false information, or impersonation.
• Abuse of the lead system or payment system.
• Spam, harassment, or other harmful conduct.
• Failure to maintain a valid license or insurance (for verified contractors).

Upon termination, your listing may be removed from the Service. Unused lead credits are non-refundable except as described in our Refund Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE QUALITY, ACCURACY, OR RELIABILITY OF ANY CONTRACTOR LISTING OR REVIEW.

WE ARE NOT A PARTY TO ANY CONTRACT BETWEEN HOMEOWNERS AND CONTRACTORS. WE HAVE NO LIABILITY FOR THE PERFORMANCE, CONDUCT, OR WORKMANSHIP OF ANY CONTRACTOR. HOMEOWNERS HIRE CONTRACTORS AT THEIR OWN RISK.

OUR VERIFIED BADGE INDICATES THAT WE HAVE CONFIRMED A BUSINESS IS LEGITIMATE — IT IS NOT AN ENDORSEMENT, WARRANTY, OR GUARANTEE OF WORK QUALITY.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MARKETTHRIVE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST 12 MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless FindingList, its officers, directors, employees, and agents from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which FindingList is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in that state.

13. Changes to these terms

We may modify these Terms from time to time. We will notify users of material changes by posting a notice on the Service or sending an email. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
